亚马逊常见的侵权行为


卖家想要避免侵权行为,首先就得加强对侵权的认识:

版权(Copyright):侵犯版权,通常指侵犯作者的著作权。这类侵权,往往发生在涉及到设计和版权方面的侵权,卖一个未经授权的DVD影片,销售一本未经授权的书本,都是属于侵权行为。

在整个版权侵权中,重灾区在卡通图案上,只要是我们耳熟能详的卡通图案,无论你应用于任何的产品上,基本上都已经侵权了。

商标权(Trademark):未得到产品品牌官方的正规授权,擅自使用对方的商标或LOGO,跟卖已注册商标的Listing,或者发布产品时把别人的商标写在自己的Listing标题、五行特性、产品描述和Search Term关键词等详情信息中,都属于侵权行为。

发明专利权(Utility Patent):如果出售的产品是别人发明的,而且别人申请了专利保护,卖家未经允许擅自生产销售,也就是指销售仿品。

外观设计专利权(Design Patent):是指对产品的形状、图案、色彩或者其结合所做出的富有美感并适于工业上应用的新设计。外观设计是指工业品的外观设计,也就是工业品的式样。外观专利有60%以上相似就视为侵权假货。

外观专利或者产品的使用专利侵权,一般来说比较难察觉,但是在美国的专利局也是有查询的渠道的。

还有就是盗图行为,盗图一般发生在第三方卖家之间,我为自己的产品拍了一套图,你看到图片不错,直接拿过去就用了,作为原图拍摄的卖家可以用原图来直接投诉。

侵权之后账户如何申诉

既然知道自己已经侵权,我们就应该最大限度的恳求亚马逊的原谅。主要申诉要点有以以下几点:

1、第一时间下架侵权产品不要抱有侥幸心理,并检测整个店铺是否有类似产品全部下架。

2、联系邮件中给出的投诉者,承认错误无心之失,言辞恳求,告知已经下架产品承诺不再销售他们品牌的产品并抄送给亚马逊notice邮箱。

3、申诉信:
资料上有进货发票和其他有效证明可以提交作为辅助;

说明已经在第一时间删除产品并保证不在销售;

加大产品品牌/专利/真伪方面的检测 ,100%确定没有问题才会上架;

组建专人团队负责核查产品信息:外观/品牌/工厂资质等;

提供供应商的联系信息管网等证明有正规的进货渠道;

保证不再犯错;

亚马逊侵权申诉信一次性通过邮件:分析账户具体情况导致问题的具体原因很重要!

我在创建LISTING的时候加了 barbie字眼,就导致侵权了LISTING被强制下架了

先确认是否真的存在有侵权行为
然后仔细阅读邮件,看邮件里给出的信息
这种侵权的话,如果投诉方愿意撤诉,链接就能保住
如果投诉方不愿意撤诉,保住链接的概率很低,但是店铺是肯定能保住的
